4M Community USA Raffle Legal Disclaimer

The Raffle is open to Meade 4M Community Members within the United States only. Employees, officers, directors, representatives, and immediate family members of Meade Instruments Corporation and their respective parent companies, affiliates and subsidiaries are not eligible to participate in this Raffle.
HOW TO ENTER: Entry by Computer: To enter by computer, sign up as a Meade 4M Community Member through the Meade Instruments Corporation website in order to be automatically entered in the Raffle. Enter your address on your profile page. Only entries with valid United States contact information before the draw are eligible. Entry by Mail: To enter by mail, send a stamped 3 x 5 card with your name, address and daytime telephone number, and email address to Meade 4M Community Administrator, Meade Instruments Corporation, 6001 Oak Canyon, Irvine, CA 92618-4205. Submission of an entry by mail will automatically enroll you in the Meade 4M Community as well as the Raffle.

Raffle promoters and/or Meade Instruments Corporation are not responsible for lost or stolen entries. Raffle entries will be disqualified, in the sole discretion of Meade Instruments Corporation, if attempts are made to disrupt the Raffle or circumvent the terms and conditions of these Official Rules. If the above occurs, Meade Instruments Corporation reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by Meade Instruments Corporation that is fair and equitable to Raffle participants. The Raffle Numbers and Prizes are not transferable or assignable and they are not redeemable for cash. All winners are responsible for the payment of any and all taxes and/or licenses and/or other related local, State, Federal fees that may apply to such winnings. Taxes on prizes are solely the responsibility of the winners. Meade Instruments Corporation reserves the right to replace the advertised prize(s) with a prize of equal or greater value if the advertised prize(s) is/are no longer available. Meade Instruments Corporation will not be responsible for replacing any lost or stolen elements of any prize package. All prizes will be awarded. Odds of winning depend on the number of eligible entries received, according to the eligibility requirements in this Raffle. Raffle numbers have no expiration date except in the event the Raffle participant is no longer a Member of the Meade 4M Community. In this case, all Raffle numbers assigned to that particular Meade 4M Community Member will expire upon the withdrawal of their Meade 4M Community membership.

Winners will be selected by random drawing once each month from among all eligible entries received. Random drawings will be held under the supervision of Meade Instruments Corporation. All decisions by Meade Instruments Corporation are final and binding. Winners will be notified by e-mail, telephone or mail, which notification will be determined in the sole discretion of Meade Instruments Corporation. Each winner may be required to provide Meade Instruments Corporation with proof that he or she is the authorized account holder of the e-mail address associated with the winning entry. The "authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to return a completed and executed affidavit and release as required, an alternate winner may be selected. Except where prohibited by law, acceptance of any prize constitutes permission for Meade Instruments Corporation to use the winner's names, photographs, likenesses, voices, addresses (only city and state), and testimonials, in print, broadcast, or new media, in perpetuity, in any manner they deem appropriate in connection with promoting this or any other raffle and/or promotion sponsored by them without further compensation.

CONDITIONS: By entering, participants agree to be bound by these complete Official Rules and the decisions of Meade Instruments Corporation, which shall be final. All federal, state, and local laws apply. Meade Instruments Corporation and its employees, officers, directors, shareholders, agents, and representatives and their parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) failed, returned, or misdirected notifications based on inaccurate information provided by the winner; or (iii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties resulting from participation in this Raffle of otherwise; (iv) errors in transmission; (v) any condition caused by events beyond the control of Meade Instruments Corporation that may cause the Raffle to be disrupted or corrupted; (vi) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Raffle; or (vi) any printing or typographical errors in any materials associated with the Raffle.

The Raffle shall be construed and governed by, and any and all actions or claims in any way related to this Raffle are subject to, the federal laws and regulations of the United States , the state laws and regulations of the State of California , and local laws and regulations of the County of Orange, California. Any and all actions or claims in any way related to this Raffle shall be filed in the courts of the State of California , County of Orange . By Providing an Entry to this Raffle, you submit to the jurisdiction of the courts of the State of California in the United States for any and all actions or claims in any way related to this Raffle, and expressly agree that such actions or claims are subject to the federal laws and regulations of the United States, the state laws and regulations of the State of California, and local laws and regulations of the County of Orange, California. Meade Instruments Corporation may prohibit you from participating in the Raffle, if at the sole discretion of Meade Instruments Corporation, you repeatedly show a disregard for the Raffle Official Rules, or act (1) in an unsportsmanlike manner; (2) with an intent to annoy, abuse, threaten, or harass any other player or a representative of Meade Instruments Corporation; or (3) in any other disruptive manner.

RELEASES. By participating, entrants agree that Meade Instruments Corporation, those involved in the development, production, implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Raffle, including entry and participation in this Raffle and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to a participant's entry or participation in this Raffle, they will indemnify Meade Instruments Corporation from any and all such claims, including the attorneys' fees related thereto. Meade Instruments Corporation shall not be liable for entries and winner notification responses that are delayed, lost, misdirected, mis-delivered, marked postage-due, illegible, mutilated, incorrect or incomplete, and such entries will be not be eligible for this Raffle. Any person attempting to defraud or in any way tamper with this Raffle will be ineligible for prizes and may be prosecuted to the full extent of the law. Meade Instruments Corporation reserves the right, in their sole discretion, to cancel or suspend this Raffle should viruses, bugs or other causes beyond their control corrupt the administration, security or proper play of the Raffle. Meade Instruments Corporation further reserves the right to modify the rules of the Raffle in any way or at any time, as long as reasonable notice is given. For an Official Winners List or a copy of these Official Rules, send a self-addressed, stamped envelope (WA and VT residents need not affix postage) 4M Community Raffle, c/o Meade Instruments Corporation, 6001 Oak Canyon, Irvine, CA 92618-5200. Replies will be sent after the completion of the Raffle. Winners List requests must be received within six (6) months of completion of the Raffle.
